The Privacy Amendment (Notifiable Data Breaches) Bill 2016, established a mandatory data breach notification scheme in Australia indicating that companies are legally obliged to notify the Privacy Commissioner and their clients of data breaches, with fines of up to $1.8 million for non-compliance.

The Privacy Amendment (Notifiable Data Breaches) Act 2017 established the NDB scheme in Australia (to be Part IIIC of the Privacy Act 1988 on commencement)

  • The NDB scheme sets out obligations for notifying affected individuals, and the Australian Information Commissioner, about a data breach which is likely to result in serious harm

  • The NDB scheme strengthens protections to personal information — providing affected individuals with an opportunity to take steps to protect their personal information following a breach.

  • Further, the transparency supported by the scheme encourages greater personal information security capability across Australian industries

Who does this law affect?

  • Australian Government agencies

  • All organisations governed by the Privacy Act 1988 including

    • All businesses and not-for-profit organisations with an annual turnover of $3 million or more

    • All private sector health service providers

    • Those that trade in personal information

    • TFN recipients (if annual turnover is below $3 million, the NDB scheme will apply only in relation to TFN information) such as Accountants.
